1. Quotations

quotations are only valid for 30 days after which a new quote can be requested

2. Payment and fees

2.1 Monthly Web design packages:

On accepting a Monthly Web Design Package the first month’s payment will be required. Once payment is received we will commence work on your project.

Monthly Web design packages are paid on a perpetual basis and in the event that you the client cancel with us, the Website remains Big Byte Solutions property and you the client will be quoted an amount to take full ownership of the website. After which we will cease all maintenance and all other fees will rest on you the client.

Monthly Web design packages have a minimum contract period of 24 months unless otherwise agreed upon, this is to ensure that we recoup the costs of building the website.

all our subscription payments are handled through PayFast unless another arrangement is made

2.2 Once-Off Web design packages:

On accepting a Once-Off Web design package a 50%Deposit payment will be required. Once payment is received we will commence work on your project.

Depending on the arrangement, once we have worked through the first round of revisions another 25% payment will be required.

Before the website is finally handed over we will require the remaining balance and then we will have over the website and upload it.

Payment for Once-Off Web design packages can be done through EFT, cash or card payments through PayFast.

2.3 Domains:

After 12 months domain names will be up for renewal and it is up to you the client if you wish Big Byte Solutions to continue managing your domain or request that your domain is transferred to another host. We will charge an admin fee to manage the payment for your domain.

Domain costs are billed every 12 months, failure to pay the domain cost may result in the loss of your domain name and/or downtime on your website of which Big Byte Solutions will not be held responsible.

3. Refunds

Big Byte Solutions requests 60 days or the time frame indicated in the quote, from the first working day after receiving the deposit or start-up fee and all required content, to complete a project. If we fail to complete the project within the allotted time frame you may request a refund of your Deposit or monthly payments Minus any costs incurred while working on your project.

4. Required Content

The client is responsible for supplying all the necessary content in an electronic format in order for Big Byte Solutions to complete the client’s project. If we have not received any content we may continue the project with placeholder content, if both rounds of revisions have passed and then only content is supplied and you want additional changes this will be an additional charge.

Necessary content includes: project details, videos, pictures, company profiles, copy (text content) etc

All supplied content supplied should be in the highest quality possible

5. Content Rights

It is the responsibility of the client to ensure that they have the necessary permission to use all supplied content or have the necessary Copyrights. Big Byte Solutions or any of its independent contractors, employees, agents, affiliates, associates, agencies etc that are involved in the client’s project will not be held responsible or liable for any copyright violations, disputes or infringements.

Big Byte Solutions reserves the right to not use any material that is deemed illegal and will remove any illegal content if notified.

6. Attribution

All websites created by Big Byte Solutions will give credit to Big Byte Solutions with a “Designed by Big Byte Solutions” link, pointing to the Big Byte Solutions website at the bottom of each page unless otherwise negotiated.

7. Web Hosting

7.1 Disk Space

Big Byte Solutions web hosting packages come with a specific disk space allocation, if the client goes over the set disk space allocation Big Byte Solutions may charge an appropriate fee for the extra disk space used.

7.2 Hosting Payments

Hosting can be paid on a monthly basis or on a yearly basis and can be cancelled at any time within our cancellation time frame. cancellation notice should be submitted at least 10 days before the end of the month or 30 days before the end of the year timespan is up. If you the client cancel your yearly hosting before the year is up you cannot get a refund for the remaining months.

Payments and subscriptions will be handled through payfast unless otherwise negotiated

If you the client fail to pay within 3 months your site may be terminated and all site data may not be recoverable.

7.3 Down Time and Losses

Big Byte Solutions is will not be held liable for loss or downtime due to technical faults, internet outages, power outages etc.

7.4 Web hosting transfer

It is up to the customer to transfer all website data in the event that the client requests a cancellation. If you the client request that Big Byte Solutions handle the transfer we will do so at a fee.

8. E-commerce website

Big Byte Solutions may charge an additional fee for adding multiple items to the e-commerce platform however it is recommended that the client gets acquainted with e-commerce platform and how to add products as they will be able to add, remove or modify as many items as they please whenever they please.

9. SEO

We don’t guarantee improvements to your website’s search engine ranking, but the pages that we develop are accessible to search engines.

10. Digital Marketing (mainly Adwords Management)

We cannot guaranty that your business will perform well on any digital marketing platform. Any money spent on any digital marketing platform may not be recoverable. Big Byte Solutions will not be responsible for any losses that may result to the client.

General:

We’ll carry out our work in accordance with good industry practice and at the standard expected from a suitably qualified person with relevant experience. That said, we can’t guarantee that our work will be error-free and so we can’t be liable to you or any third-party for damages, including lost profits, lost savings or other incidental, consequential or special damages, even if you’ve advised us of them.

Your liability to us will also be limited to the amount of fees payable under this contract and you won’t be liable to us or any third-party for damages, including lost profits, lost savings or other incidental, consequential or special damages, even if we’ve advised you of them.

If any provision of this contract shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this contract and shall not affect the validity and enforceability of any remaining provisions.

By using and accessing our services, you agree and accept to be bound by the terms and conditions of this agreement. When using our services, you shall be subject to any posted rules or guidelines to such services. Any participation in our services will establish acceptance of this agreement.
